All participating companies whose offer is contained in this booklet reserve the right to change the conditions of their offer, extend, alter or withdraw the offer or any part thereof without assigning any reason whatsoever.

Any disputes with regards to these offers will be subject to the jurisdiction of the courts of New Delhi.

Any disputes regarding delivery, service, suitability, merchantability, availability or quality of the offer and / or products / services under the offer must be addressed in writing, by the customer directly to the respective participating companies.

These offers can be availed only in the outlets mentioned in each offer. The list of outlets mentioned either on the reverse of the offer or under the 'Participiting Outlets List' at the end of this brochure.

To avail these offers please present the Gif Certificate of the respective participating Company at the billing counter along with the card unless specified otherwise.

Tata cards shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered by a customer, directly or indirectly, by use or non-use of the products / services under the offer.

The term "Value Back" does not signify a new offer or promotion on Tata Card. It only communicates the existing features and benefits for the Tata Credit Card's Empower loyalty program.

"Value Back" does not mean 'Cash Back'. The value is being given back in the form of certain 'Empower Points' that are credited into the cardholder’s credit card account by virtue of being a participant in the program.

Empower points can only be earned on valid retail purchases (the points cannot be earned on cash withdrawal transactions or other equivalent transactions).

The number of Empower points which can be earned will vary for each empower partner brand. Please refer to the Empower points summary grid for specific details on the number of points that can be earned for each participating empower partner.

' 1% Value Back on other purchases' means that a minimum of One (1) point can be earned for every Rs.100 spent on the Tata Credit Card at participating as well as certain non-participating establishments.

Any value higher than 1 point for every Rs.100 worth of purchases (varying between 2% - 5% Value Back) will accrue only for purchases made at participating Tata establishments, if:

The merchant is part of the list of participating Tata establishments.

The Tata Credit Card is used on a Tata Credit Card EDC terminal at the merchant (In case the Tata Credit Card is used on any other bank's EDC then the minimum 1 point per Rs.100 will accrue.

Value of Empower points: each Empower point is equal to Re.1 having regard to Clause 2 here in above . The Empower points can only be redeemed for equivalent value of merchandise at participating Tata establishments. Redemption against airmiles will be done at the conversion rate that has been agreed between Tata Cards and the respective airline partner.

Redemption of the Empower points at participating Tata establishments will only be against merchandise available at the participating store. The redemption in such a situation will be possible only if:

The merchant is part of the list of participating Tata establishments.

The Tata Credit Card is used for the redemption transaction on a Tata Credit Card EDC terminal at the merchant (This transaction would not be supported on any other bank's EDC terminal).

Tata Credit Card solely reserves the right to modify or change any of the terms and conditions applicable to the Program at any time or to withdraw its participation in the Programme at any instant at its sole discretion.

The feature is being made available by Tata Credit Card purely on a “best effort basis”.

The aforesaid eligibility considerations and the aligned mode and manner set forth by Tata Credit Card to its Tata Credit Cardholders and consequent conditional benefits which may be made available to such cardholders collectively forms the mutual consideration for Tata Credit Card and its Credit Cardholders under this Program. Tata credit Card specifically disclaims any other liability except as set forth in the terms conditions contained herein.

Any disputes arising out of this Program shall be subject to arbitration to be conducted by a sole arbitrator appointed by Tata Credit Card for this purpose. The place of Arbitration shall be New Delhi and language of Arbitration shall be English. The decision of the Arbitrator shall be final and binding on the Parties.

The existence of a dispute, if any, shall not constitute a claim against Tata Credit Cards.
